These Terms & Conditions govern the use of the website https://tixfin.com and participation in the TixFin beta programme.

§ 1 Scope
These Terms apply to the use of the website and the services provided by Quavon UG (haftungsbeschränkt) (the “Provider”) as part of the beta programme. Deviating terms of the user do not become part of the contract unless the Provider expressly agrees to them in writing.
§ 2 Description of services and beta status
TixFin is a platform for event commerce (ticketing, seatmaps, shops, payments and more). The platform is currently in a beta phase.
Beta services are provided “as is” and “as available”. Features may change, be limited, or be discontinued entirely. There is no claim to any specific functionality or to uninterrupted availability during the beta phase.
§ 3 Participation in the beta programme
Participation in the beta programme is voluntary and may require registration. The user warrants that the information provided at registration is truthful. The Provider may grant, restrict, or end access to the beta programme at any time and without stating reasons.
§ 4 User obligations
The user undertakes not to use the platform unlawfully, in particular not to infringe third-party rights, not to introduce malware, and not to take any measures that impair the availability or security of the platform. Access credentials must be kept confidential.
§ 5 Availability
The Provider endeavours to keep the platform highly available but gives no warranty to that effect during the beta phase. Maintenance, further development, or malfunctions may cause temporary restrictions.
§ 6 Pricing
Participation in the current beta programme is free of charge unless expressly stated otherwise. Should paid plans be offered in the future, the applicable payment, billing, and cancellation terms will be presented separately before any contract is concluded.
Prices quoted to business customers are net, exclusive of statutory VAT. Prices quoted to consumers are final prices including statutory VAT (§ 3 PAngV).
Paid services will only be offered through an order process that states the essential characteristics, the total price, the term and any minimum term directly above the order button, and whose button is labelled “zahlungspflichtig bestellen” (§ 312j (2) and (3) BGB). Where a paid continuing contract is concluded online with a consumer, a cancellation button under § 312k BGB is provided on the website.
§ 7 Right of withdrawal for consumers
This section applies only where the user is a consumer within the meaning of § 13 BGB and obtains a service for a charge. The beta use currently offered is free of charge, so a right of withdrawal arises only with the first paid contract.
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal you must inform us — Quavon UG (haftungsbeschränkt), Langbehnstraße 39, 83022 Rosenheim, Germany, email: contact@quavon.de, phone: +49 175 4251056 — of your decision by an unequivocal statement (for example a letter sent by post or an email). To meet the deadline it is sufficient that you send your communication before the period expires.
Effects of withdrawal: If you withdraw, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days of the day on which we receive notice of your withdrawal, using the same means of payment you used for the original transaction unless expressly agreed otherwise. No fees are charged for the reimbursement.
If you asked us to begin performing the service during the withdrawal period, you owe us a proportionate amount for what has been provided up to the point at which you inform us of your withdrawal. The right of withdrawal expires once the service has been fully performed, where performance began only after your express consent and your acknowledgement that you lose the right upon full performance (§ 356 (4) BGB).
Model withdrawal form: To Quavon UG (haftungsbeschränkt), Langbehnstraße 39, 83022 Rosenheim, Germany, contact@quavon.de — I/We hereby give notice that I/We withdraw from my/our contract for the supply of the following service …, ordered on …, name of consumer(s) …, address of consumer(s) …, signature (only if notified on paper) …, date … .
§ 8 Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body, or health. In the case of simple negligence, the Provider is liable only for the breach of a material contractual obligation (cardinal obligation) and limited in amount to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the German Product Liability Act remains unaffected.
For free beta services, liability is – to the extent legally permissible – limited to intent and gross negligence.
§ 9 Data protection and processing on the user's behalf
The data the Provider processes when you visit this website is set out in the privacy policy.
Where the Provider processes personal data on the user's behalf — in particular the ticket buyer data of an organiser — the Art. 28 GDPR data processing agreement applies. It forms part of this contract and is available at /avv; separate signature is required only if the user asks for it.
§ 10 Changes to these Terms
The Provider may amend these Terms with effect for the future where this is necessary for a valid reason (e.g. a change in the legal situation or scope of features) and the user is not unreasonably disadvantaged as a result. Users will be informed of changes in an appropriate manner.
§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Rosenheim. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
